PRODUCTS LIABILITY

Products liability is the field of law which refers to the legal liability of manufactures and sellers to compensate buyers, users, and even bystanders, for damages or injuries suffered because of defects in goods purchased. A tort (i.e., a civil wrong) which makes a manufacturer liable if his product has a defective condition that makes it unreasonable dangerous to the user or consumer. Blacks Law Dictionary, Sixth Edition

Read the Uniform Commercial Code (UCC) which all States have adopted which covers product liability and breach-of-warranty.

As a private investigator the information included herein is not intended to give legal advice nor is it to substitute for your need to consult with an attorney. This entire field of law is very complicated regarding specific legal issues which require the advice of legal professionals.

There are several issues that a private investigator may advise you concerning for example, how to hire the most competent Attorneys in this field plus following up on their advice.

As a manufacturer you may need a thorough study in how much risk you are taking by selling this manufactured product. You may need a risk assessment as to your products vulnerability to be defective. Also, some products are tampered with and are defective because of employee frustration or hostility. Through an employee interview you may discover purchasing guidelines which are not being followed or a third-party supplier who is not carrying required liability insurance. Many manufactured items go through several sources before being acquired by you.

You may have liability insurance. Most insurance companies are past masters in getting out of having to pay liability damages. I suggest you talk to an attorney before you prepare a claim or try to defend yourself from a claim.
