PROFESSIONAL INTERVIEWING

A professional interview may be necessary in cases involving criminal defense, domestic witness and eligibility of expert witness. To determine relevancy and veracity of prior statements made by the person interviewed.

The type of case and its complexity determine the interview format. In all interviews pertinent information may surface that need to be followed up on.

Today we are reading of many criminal convictions being dismissed by the introduction of evidence produced by advances in scientific research. Not only in DNA analyzes but also in the original evidence that was used to prosecute. Currently there exists wide body of law to protect the defendant but in reality some law enforcers do not follow these guidelines. However, in all fairness to the officers, the overwhelming majority stays legal in their efforts in obtaining evidence and protects the rights of defendants.

Depend on lie detector examinations is a study in futility. Not only is the test inadmissible in some jurisdictions it is prone to error or used as a bluff to illicit a confession.

We approach an interview with an understanding of all evidence and statements, and the elements and issues involved.

In some cases a court reporter may record the interview. We use the most sensitive speech recording devices available. If at all possible, a camcorder with both visual and recording capabilities.

We solicit the cooperation of the person being interview. This cooperation may be to his benefit.

All jurisdictions set guidelines covering the rules of evidence and court procedures. It is essential a properly conducted interview abide by these rules.
