COMPLEX LITIGATION
It is an Attorney's responsibility to fully
investigate a case. A lawyer can be negligent
in not properly investigation a client's
case where personal injury and death is involved.
Many complex cases come about by injuries
incurred when workmen are using highly complicated
machinery. These cases usually end up in
Workman, "Person", Compensation
courts.
Be aware that not only may your employer
be found negligent but also third parties
negligent in repairing a piece of the equipment,
which might include the freight company that
damaged the equipment and failed to report
it. The original manufacturer and their third
party suppliers may have contributed by manufacturing
an unsafe piece of equipment.
It is a rare case where there is only one
party to blame for the injuries. Some employees
out of loyalty and fear of losing their jobs
assume that the accidents are their fault.
Whereas, in later months or years the injury
may resurface making a permanent cripple
of the person.
Most all accidents, whether on the job or
because of a vehicle accident or just plain
Jane events, involve contributory negligence.
For your sake report the accident, before
a statute of limitations is enforced, and
if at all possible, obtain the names of witnesses,
medical damage reports, photos, and statements
which the other parties gave to the law enforcement
officers. Plus notify the claims department
where you are covered by any form of insurance
and follow their written instructions.
Do not take for granted that a simple case
like a slip and fall is a no-brainer for
an attorney. He must have photographs, witness
and proof that safety standards have been
violated. Photos must illustrate the location
and the hazard. Plus other elements.
Contact your county or state Bar Association
and get the names of those firms that specialize
in accident and complex legal cases.
