CRIMINAL & CIVIL INVESTIGATIONS

Both investigations require a different approach. Whether it is doing a background search or finding and interviewing potential reliable witnesses for criminal and civil purposes. This may require checking for alibis, witness statements, looking for extenuating circumstances to aid the defendant. Examine police reports, identify witnesses who gave previous statements to officers and possibly perjured themselves. Maybe your potential witness may have extensive previous raps sheets of his or her own.

Most criminal defendants are indigent and represented by a public defender attorney. It is easy to say that the public defender’s quality of service as a public defender is about as good as what the client paid for. Conversely most lawyers serving an indigent client are not paid a fee that will cover their true out of pocket expenses.

In civil investigations you may be searching for assets, fraud, proof of breach of contract, negligence, perjury, to locate or to interview witnesses. Sometimes you need surveillance to help build evidence for an Attorney’s case.

A good attorney should be active in securing evidence to prove his case or acquire evidence for a client. Look at recent high profile cases. The amount of money spent for outside investigations must have been very high. Unless your attorney orders these investigations you run the risk of losing your case. The second problem is that most investigations require clients to pay a retainer up front just like a good attorney will require a portion of his fee to be paid in advance. If you do not have the funds available, then you need to ask your attorney for a list of the issues involved. Ask him what evidence or proof he needs to prepare your case. You then can go to a law library and find the elements needed for that particular issue. Call any potential witness and ask for his/her input. If they can furnish statements benefiting your position, then ask for them to sign their statements. Take photos, camcorder and tape recorder evidence. Do not try and edit your recorded devices, but put on a time date stamp and an address to verify the location on all. (Location verification can be made by taking an up close photo of a landmark, address or building that was in your original photo).

One other word of (non legal) advice: Young attorneys lose cases they should not have lost. Old attorneys win cases they should not have won.
